Workplace smoking can seriously damage your wealth - Company director fined for workplace smoking Martin Lenehan, Operations Director at Metric Scaffolding Ltd, has been prosecuted for smoking in his office following complaints from fellow members of staff. Although Metric Scaffolding Ltd had already been issued with a warning for violating workplace smoking legislation Mr Lenehan continued to smoke at his desk and in office vehicles. The Council was tipped off about Mr Lenehan’s conduct by an anonymous colleague. The Council then investigated and on their first visit they uncovered proof of the claims. They subsequently issued a warning to the company that they needed to ensure all workplace areas remained smoke free to safeguard their workers from the potential harm caused by passive and active smoking. This did not happen and Mr Lenehan was issued with a £50 fine which he refused to pay. The Council proceeded to prosecute and Leyland Magistrates Court fined him £175, along with £75 costs and a £15 victim’s surcharge. This case serves as a warning to those who break the anti smoking laws as colleagues, are willing to report on others, even where more senior, to protect their own health.
