First Corporate Manslaughter Prosecution

We reported in our April edition on the first prosecution under the Corporate Manslaughter Act 2007 against Cotswold Geotechnical Holdings Limited. Cotswold Geotechnical has been charged with the new offence of corporate manslaughter and the company director faces a charge of gross negligence manslaughter.

The trial is now sheduled to start in February 2010. Cotswold Geotechnical and the director also face charges under the Health and Safety at work Act for failing to adequately protect their employee's safety. The Cotswold defendants have both pleaded not guilty to the CMA charges. We will keep you updated on progress.
